Florida man’s alimony case to be reconsidered by lower court

A Florida man has recently received a favorable court ruling after protesting a ruling about his alimony payments. The man had appealed his case to the 5th District Court of Appeals after a circuit court failed to adequately account for his various alimony payments. His case focused on the permanent, retroactive alimony that was enforced by the lower court.

In this case, the man said that he had made several temporary alimony payments to his estranged wife between August 2011 and April 2013. Those temporary alimony payments were apparently not considered in the lower court’s judgment against him for ongoing spousal support. The man questioned why those alimony payments were not considered, and he also protested the award of more extensive spousal support, arguing that standard of living was not appropriately characterized in the court hearing.

In addition, the case considered several loans that had been used to purchase a vehicle for the couple’s son, along with the young man’s student loans. Those loans had apparently not been considered during the alimony proceeding, which may have led to an unfair ruling by the lower court. Now, the appeals court has remanded the case to the lower court for reconsideration.

Ultimately, the man may be able to get a fairer ruling because the facts of his case will be reconsidered by the lower court.
